Pay fixation on direct recruitment

sir,

I joined in an organisation under direct recruitment quota. My pay fixed at minium of pay as per the rules. However a junior joined after 2 years of me,whose pay was fixed under FR 22(1)(a)(1) by granting one increment on last basic(pay+Gp) what he was drawing as the pay+gp of new post is more than the old post.(Higher responsibilities are involved taking into grade pay of old post is 4800 and new one is 5400) 

In this regard the following querries may please be clarified:
1) whether FR 22(1)(a)(1) is applicable to direct recruitees or not? if yes, is there any OM of GOI is available. if not, which OM specifies.

2) if applicable, whether a junior can draw basic pay more than a senior. Is there any scope to protect the senior with pay of junior wef his joining

3) is there any court cases such instances or any GOI guidelines in support of my argument to protect my pay.

A DR appointee who holds higher basic pay than initial pay is entitled to pay protection and pay fixation as per FR 22(1)(a)(1) rules itself is clear no GOID required. In such case he can even draw higher pay than senior and the said senior has no case of upgradation.

Sir, I am working in  Central Govt. autonomous Org. and as on 01.07.2015 my B.P.+ G.P-is Rs. 10520+2400(PB-1) . I joined higher post (through proper channel) on direct appointment  on 12.10.2015 in same department in grade pay Rs. 4200( 9300-4200) PB-2.

 Sir what will be my pay fixation if I opt for pay fixation wef 12.10.2015.
