power of attorney

Hi , I am planning to buy a property through a person who holds the general power of attorney (GPA). The person is husband to the owner of the property. This property is in Bangalore but the GPA is taken at Delhi.

1) This GPA need to be rigistered at Bangalore?

2) If it is registered in Delhi, how to veryfiy if its registered in Delhi and it is authentic?

3) Can I buy the property through this GPA?

4) What all checks I need to make to veryfiy the validity of this GPA?

1) This GPA need to be rigistered at Bangalore?

Ans. Not necessary it can be at Delhi also.

2) If it is registered in Delhi, how to veryfiy if its registered in Delhi and it is authentic?

Ans. You need to check it by hiring services of an lawyer at delhi to search the relevant docs with the SRO to verify the authenthicity.

3) Can I buy the property through this GPA?

Ans. Yes you can purchase it through the GPA.

4) What all checks I need to make to veryfiy the validity of this GPA?

Ans. Check whether the GPA is live and has not been revoked, put up a public notice about the intended purchase and obtain a Encumberance Certificate for 30 yrs to see whether any charges/mortgages are created on the property. Apart from this engage a lawyer to obtain a thorough legal opinion on the property by verifying all the parent/link documents etc...
