power of attorney

hi im han just wanted to clear my frnds doubts on power of attorney????

1.can a power of attorney be on plain paper??? or on stamp paper????

2.can a power of attorney be signed by two witness and the testor???

3.can a power of attorney be registered or is it not nessary????

4. life of power of attorney   or duration of the validity of the documts???

5.wots is the stamp duty for registration of power of attorney???

and just wanted to kmw if the person who gave power of attorney dies is the power of attorney valid after his death??? and can the holder of power of attorney use the doucument after wards???pls clarify????

1.can a power of attorney be on plain paper??? or on stamp paper????

Ans. If executed in India it has to be on a stamp paper or if executed outside India then after receiving it in India it has to be adjudicated for proper stamp.

2.can a power of attorney be signed by two witness and the testor???

Ans. Witness is not a pre-requisite and witness is not a bar, however it can be notarized and the principal can sign before the Notary after identifying himself.

3.can a power of attorney be registered or is it not nessary????

Ans. Registration is optional except if it is a POA for sale of immoveable property.

4. life of power of attorney   or duration of the validity of the documts???

Ans. Until it is revoked by the Principal or upon death of the principal or the attorney holder.
