Probating will

 

Hello

My father passed away two year ago and had his death WILL  written on a plain paper and signed by two witness ( My mom and my dad brother).  And now I wish to probate this WILL.

My question are:

1. What should I do to probate the will? Please explain the procedure and charges. I reside in Kerala

2. He has made many written mistakes while wirting the will (like striking off words and  writing above it). Is this WILL still vaild?

3. Also he had signed only in the last page of the will. Is this fine.

Any help/suggestion highly appreicated

For  a will relating to property in Kerala, probate of the will is not mandatory. THe property mentioned in the will can be distributed based on the will, supported by affidavit or any indemnity as may required. However, if there is any dispute in the will, then probate of the will would be necessary.
