Property sale

Sir,

I have bought already built independent house on bank loan  from the original house owner. Before buying I clearly mentioned that I iwllbe buying the house only if I get a home loan from govt banks. The value of the house was told to be 30,00,000.

I gave some token advance and made an agreement which says I will be payingt he remaining amount after 45 days. In mean time before my agreement date I paid 10 lakh rupees. Because of some delay in getting home loan we convinced him to extend the agreement date to 60 days. Then I apid anaother installment of 12 lakh.

There was still some delay in sanctioning home loan because of some delay from bank. Finally I got a checque of work 20 lakh from the bank on the house owners name. I handed over that 20 lakh rupee cheque to him since he told he will return the remaining money.

So already I gave 22 lakh and now through cheque I gave 20 lakh. So he should return 12 lakh to me since the value of property is 30 lakh. But he returned only 10 lakh.And he says he wont return remaining 2 lakhs since I delayed the payment by 45 days. He says 2 lakh is the interest for the delay.

Please let me know whether I can file a case against him requesting my money back.

u making a Agreement for Sale for that and the agreement is registered in registrar office? please see the condition of the agreement and request them this is the procedure of bank and actually we r ready to pay amout as per condition but bank procedure is delay for some internal reason of bank this is not cheating if they r agree with u.
