Regarding filing criminal case - nri

Hi -  I have 1 acre of land near Hosur, Tamil nadu and its agricultural property and obtained through inheritance, i am trying to sell the property but few miscreants in our village is threatening to the people who come to purchase the property telling that there is a road on property and we will have to leave the road for them, but when we checked the map there is no road present at all in registry, they are threatening by telling that we will call local MLA and because of this none of the parties are showing interest in buying the property and some people are asking for very less price.

These miscreants have created unnecessary problem or litigation even though documents are fine.

First of all is there any law in India which can help NRI like me to stop this nuiscance and not sure if police will help (heard that they are extremely corrupt).

Can someone guide here?

You should seek professional services of a local prudent lawyer to contest the case(s) if any.

However, your attorney has to satisfy the vendee (purchaser) regarding marketablity of the property under sale / purchase, which is more the duty of purchaser.

This type of problems are generally prevalent in the local due to rivalry or rowdyism by local people.

You may give a complaint against the persons who create direct problems to the top police officer of the city.

Even otherwise such problems should be sorted out through local sourcesd only

The police may not entertain the complaint stating it to be civil matter.

Admittedly, the property is under litigation. You need to face the issues on its merits.

Hi,

I understand the difficulties you're facing with the threats and interference in your property sale. There are legal provisions in India to protect property owners, including NRIs, from such nuisances. You can file a criminal complaint against those creating these problems, and there are also civil remedies to address this issue.

Feel free to reach out to me at contact@advanshumansingh.com, and we can discuss your legal options to resolve this matter.

Looking forward to assisting you.
