Reply to labour enforcement officer

Sir,

I got  a letter from Labour enforcement officer stating that " Inspection Report in Respect of XXXX, Kerala Engaged in contract work of  "Providing Security Services for XYZ Bank, Coimbatore Undre the Minimum Wages Act 1948 and its Rules 1950.

the irregularities noted during inspection is given

1. Muster roll in Form V is not maintained at all/ correctly and kept at the work spot( breach of Rule 26(5).)

2 Register of Wages in Form X is not maintained ar all / correctly [ breach of rule 26(1).]

3.Register of overtime in form IV is not maintained at all / correctly [Breah of rule 25 (2). ]

4, Register of Fine in form I is not maintained at all / correctly [Breah of rule 21 (4). ]

5.Register of Deduction for damage or Loss in form II is not maintained at all / correctly [Breah of rule 21 (4). ]

Please give a necessary reply for this. Our office is located in Thiruvananthapuram Kerala and the staff is employed at Coimbatore, Tamilnadu. The notice is issued by Labour Enformcemet Officer (Central), Chennai

you may be in Kerala, but your workers in coimbatore fall under TN, so you shd maintain as per TN procedure folloed by LEO, so you have to maintain all the registers as he had asked you to maintan sir. tks

It is not advisable to use a draft/ format in your case. Your reply should stand on legal footings as well as be stable from factual aspect. As told by Mr. Doab, consult a specialist.
