Road accident due to carelessness of jaywalker

My brother was driving on AH43 and suddenly an old man aged 79 tried to cross the highway in a hap hazard manner. My brother applied brakes and tried to save him but the dilemma in the old man's mind made him toss back n forth multiple times causing a collision between him and the side of the car.

My brother called an ambulance for him but unfortunately the jaywalker was declared dead. Knowing this my brother himself called the police, as a responsible citizen, to report the matter so as to avoid any misunderstandings but instead he was booked under Sec. 304A, 279. For no mistake of his own, he has been booked.

Please note, he could not apply the brake to sudden stop because of high speed vehicles coming from behind could cause fatal accident. He is an experienced and responsible driver and was well within speed limits.Also, he was not under the influence of alcohol.

Kindly suggest a way so that he may get justice.
