Sajjan kumar case

Dear Members,

Even a 3rd grade student can understand what nonsense (read - CORRUPTION) has happened in previous trial of Sajjan Kumar where he got acquittal .

Therefore, will the lower court judge  (who acquitted Sajjan Kumar, but convicted some others, on the basis of the statements of same witnesses ) be removed from his post and convicted now ? Do judges in India have such wide discretionary powers ? If the judge is not removed and convicted, will he not continue to pass such SICK judgments ? After all, he can convict an innocent, and acquit a culprit with impunity. He wil also be a source of inspiration for other judges throughout the country.

There are laws and rules for everyone.

Judges can be tried, impeached.

You view poitnt seems to be more SICK.

None is perfect...to err is human...if the lower court judge had committed some mistake or error in judgment the same has been rectified by the Higher Court.

There is a clear set up available to erradicate such errors.

Even if Sajjan Kumar (no sympathy for him otherwise) has been convicted by HC, he still has a right to file an appeal before the Supreme Court.

There is no need to go abusive against any judge.  Even in Western world the judgments are reversed by higher courts if there is error in the judgment of lower court.

Dear Mr Kiran Kr,

I am surpised that you being a lawyer, are not able to see what has happened in Sajjan Kumar case.

The lower court had acquitted him ! while convicting others. This was certainly not a 'minor' error committed by the judge. 

Judgments can be reversed when there is doubt. But one court acquits a person of MURDER, and another court convicts !! This is a minor thing, according to you ?

"Vast majority of Indian Supreme Court judges are people of very low intellect."

I am not saying all this. Please google for the author of these statements.  Thank you.

I agree that there are loop some holes in the Judiciary System. But, certainly one can go ahead with the provisions mentioned in the same Judiciary Systems and file a petition for  Appeal.

The aggrieved litigant can also file the petition for Review or Revision too, so as to rectify any improper exercise of Judicial Power.

As mentioned by the Expert "Kumar Doab" - There are laws and rules for everyone. Judges can be tried, impeached". Agreed with the expert "Kiran kumar" too.

Please go through the Judgement (it is the reasoning given by the judge as to why the decree). He must have mentioned the reason for such decree.
