Sale agreement

Please advice me in the following matters as soon as possible:-

One of my client made an sale agreement with promoter to buy a Flat at Santoshpur, Kolkata- 700075 15 days ago. On that vey date the client draw a cheque of Rs. 3,00,000/- in favour of the promoter. But after 2 to 3 days he realize that the account from which the cheque was drawn is not the proper one and hae no balance In between the agreement is signed and notaried. My client now want to pay the promoter a fresh cheque of another account. Promoter have no problem to accept it. Now it is my question what to do in the sale-agreement to change the cheque no.,bank and date.

Dear Nirupam Diwan ji

as per legal opinion it is mandatory to mention the cheque no. bank and date if the same is in relation to first cheque. because today the relation is good but no one knows about future and mind of the people so for your precaution mentioned in agreement all the facts
