Ours is a Society Formed 3 years Back. Though we have got possession of the Flats but due to some reasons the Share Certificate allotment has not been done. The same will be completed within a years time. I am intending to sell the Flat. However Society is not giving me NOC in writing and declaration that the Share Certificate will be issued in Due course. However they are giving No dues Certificate.
What is the remedy. Buyer wants representation from Society that the Share Certificate will be issued in due course and Also a NOC from Society for selling the Flat. Can I ask Legally to Society to give such a letter/NOC, if yes, what is the process. Bye-laws are silent about these issues.
