Please let me know whether as per Order 41,Rule 6 we can give a security bond in place of a cash deposit as demanded by the High court in case for staying the execution of a decree on specific performance of contract. Since the amount involved is almost a one crore and the petitioner has freinds/relaitives who can give a security bond - property worth that much amount- as per appendix G Form No 3 of CPC/.The HIgh court had ordered for a cash deposit.But the petitiooner has no liquid resources and is willing to give a security bond.
