Singur land rehabilitation and development bill constitution

A single judge Bench of Calcutta High Court today ruled that the Singur Land Rehabilitation and Development Bill 'is constitutionally legal'.

Justice Indra Prasanna Mukherjee held that the act was framed under the provision of the constitution.

Tata Motors had moved the high court challenging the constitutional legality of the Bill which was passed by the West Bengal government to take back the land from Singur, leased out to Tata Motors to set up a small car factory.

Justice Mukherjee, however, said the ruling could be effective after November two, giving an opportunity to the auto major to move the higher Bench of the court against the judgement.

Justice Mukherjee also held that the auto major may seek compensation under section 23 and 24 of the Land Acquisition Act and directed Hooghly district judge to settle down the issue in six months.

The court also authorised the district magistrate and the Superintendent of Police as special officers to look after the shifting of Tata motors movable property from the project area.
