We have a Leave and License Agreement ( registered in Mumbai ) which is expiring on 31-March 2013.
However the tenent has stopped paying the monthly rent saying that they are adjusting the rent against the Deposit. By March 2013 the deposit will be reduced to zero. There are ten months to ge for the expiry of Agreement.
However there is no such provision in the L&L agreement- the deposit is to be repaid only on vaccation.
What is the remedy?
Would a legal remeday such as getting eviction notice be a practical one considering costs involved.
