transfer of the property?????

respected ,HERE IS A PROPERTY OF MRS."X" SELF ACQUIRED.SHE WANT TO GIVE THE PROPERTY TO HER GRANDSON MR."Y". SHE CAN MAKE A WIIL FOR FAVOUR OF MR."Y".RAGISTERED WILL

NOW SHE MRS"X" WAS EXPIRED AND MR."Y" ARE THE OWNER OF THAT PROPERTY (IT'S A EMPTY PLOT) IN UTTAR PARDESH .

NOW MR."Y" WANT TO TRANSFER THE PROPERTY .

NOW WHAT SHOULD HE DO ???????

to whom he to transfer? 

if for others, the will and the death certificate will do.

It can be mutuated easily in his name also with the help of same documents

on the basis of the will try to mutate the property in your name then the transfer of the property arises .

on the basis of index  ii of the gift deed,i assume that  mr.y have mutated his name to 7/12 extract of the plot. if his name appeared on the 7/12 extract as a owner of the plot.he can transfer the property by sale deed.

 mr."y" wants to transfer the property in his name .

Q.1- it is necessary to probate the will in uttar pardesh in this case.?

Q.2-can the legal hire of mrs."x" create a any type of problem to mr."y".

Q.3-can the legal hire of mrs."x" claim any type of share on the plot .if will of mrs."x" is persent.

Dear  Raj Kumar Ji

There is not mandatory requirement of Probation of Will in the State of Uttar Pradesh.

The other legal heirs cannot object the Registered Will executed by Mrs. "X".

Even when Mrs. "X" is alive, the property acquired is self, hence, she has absolute powers to transfer such property in favour of any person to whom she is willing to tranfer.
