unregistered GPA

I'm planning to buy a house in Bangalore. The owner of the house has purchased the site on 2002 from a person who has unregistered GPA which he got on 1996. Now the property has a registered document based on the unregistered GPA. When I approached the bank for loan, they are asking for a confirmation from the first owner of the property. We dont know who was that owner and we could not trace him. In this forum some lawer has answered for a same type of question, that because of the property was registered in a sub-register office, based on a unregistered GPA, there is no problem in buying the property. Please clear.

My Dear Friend,

Under Section 32 of Registration Act Power of Attorney is needed to deel other than the owner.  Section 33 says (a) If the principal (Owner) at the time of executing the power of attorney resides in any part of India in which this Act is for the time being in force, a power of attorney executed before and authenticated by the Registrar or Sub-Registrar within whose district or sub-district the principal resides:  to deel before sub registrar power either to be authenticated  or Registered by the Sub registrar at Owner's place.  In your case registration completed hence Bank people desiers conformation for their safety. They may dispose your lone by giving a paper advertisement calling objections on your title in the case of whareabouts not known of principal/agent.
