My wife filled a false 498a in 156 3 just after two months of my marriage and court ordered for investigation and FIR and asked the investigation officer to submit the report in 90 days, IO did 90 days long investigation and submit the final report that all the allegations are false and wife and her parents want to extort money from the husband, megistrate's decision is still pending, I discussed my wife, now she is saying that she wanted to stay with me, when I asked her why she filled a case against me then she told that her father and advocate misguided her to get the money.
Now wife filled a case of maintanance, till now I did not recieve any notice or summons from the court but I got to know that court has sent three summons but her lawyer is managed NOT to reach these summons at my place.
I am handicapped and working as a software engineer my wife is post graduate in three subjects and did contractual job in BSNL for three years just before marriage she is having PAN number and bank account also.
Can the court give any ex-party decision on maintanance in this case? or what are the option am having?
I am having my job at 3000 Km. from the court and can NOT proceed with the proceedings.
Can anybody help me in this how me and my family come over this or can I filled a divorce case against her as my marriage happenend in NOV. 2008.
