498a trial to be completed by this month end

If they are convicted, they would be asked to deposit the fine, if any, and then would be enlarged on bail to appeal in Session Court.

Hi Shonee Sir,

Her (Wife) articles are with me only. I dont want to give it to her so easily, whether i acquit or convict in 498a case

as i had underdone lot of mental disturbance, financial loss, job loss in these 4 years

She had already written in FIR, chargesheet, chief examination that she had given those articles to me but hasn't submitted any  receipts for the same.

Is there any other medium for her to claim for return of articles like police, dv act....etc please suggest ( i dont want to return her articles so easily, as i had gone through many hardships fighting these false cases, so i wil face any cases regarding return of articles)

You mean to say, because of some misunderstandings the wife sends the whole Husbands family to jail for a week, and you expect rajesh to forgive her. when he  & his  family has lost dignity, respect  by the way of Filing False cases just to meed their unlawfull demands. it is not wist to  take back her, aslo this should be a big lesson to All B******s  to think over 100 time befor filing the false cases against husband and his family memebers. Jusgt follow the advice of Shone and Bharath.

If you retain the articles of your wife despite her demand for the same, you are committing a crime. And loads of avenues are open to the wife to claim the same.

I mean to say that i will return her articles anyway but no so much easily, i want her to obtain her articles through legal route. What are the legal routes available to her (already 498a, DP 3&4 is running in court and judgement is next saturday)

Please follow the advice of Shonee Ji. Your wife may be trying to collect evidences to prove that

1. She gave articles to you at some point of time
2. You are refusing to return those articles.

If she is able to prove the above points, you will be convicted u/s 406IPC.

DP 3&4 already filed and mentioned that she gave all articles at the time of marriage, so i guess thats why only DP 3 & 4 sections added in case along with 498a.

Suppose  If I am aquitted in 498a, DP3 & 4 next saturday, still she can file case for return of articles (urgent reply needed as i have to prepare since my judgement is next saturday)

She will claim her articles or cost of her articles one day. It will be better that you ask her to take it. You must not refuse to return her articles, if she demands.

Sir,

In her 498a, DP 3&4 case, she told they had given 5 lakh cash, 300 grams of gold (which are false allegations), at the time of marriage,is  this cash and gold also come under stridhan? ( i think we are booked under DP3 section for this only).

So can i use this judgement copy of 498a, DP3 &4 (if am acquitted in next saturday judgement- 24/03/12) if she claims for stridhan and return of articles.

( i was asking all these queries because i want her(b*tch) to move around the courts like me and my family)

Revenge is a negative emotion.

Anyways, I guess now the limitation period for filing 406 would also have expired.
