Ad Interim stay

A division bench of high court has granted ad-interim stay against single judge branch order till 07-07-2021. Till now it has not been listed for hearing. Whether the ad interim stay is still in force or automatically vacated?

Yes, Ad interim stay will remain in force till it is not vacated by order of court.

Dr J C Vashista (Advocate)     17 August 2021

Since the court has stated to have granted interim injunction wherein the order it is mentioned specific date i.e., 07.07.2021 it stands vacated since 08.07.2021

Consult your lawyer for further queries who is well aware about the facts and circumstances of the case.

Technically, the stands vacated. However, there are some general orders issued by various High Courts extending the life of such Orders because of the Covid situation.

Please appreciate the fact that the High Court granting such an order is also well aware about prevailing COVID-19 situation, even then specified the date.
