Criminal MA was kept for Dismissal Order before the JMFC but for biased behaviour I filed Transfer petition u/s. 408 of Cr. P.C. before District Judge and the proceedings in Criminal MA was stayed
Myself and the Opponents Advocate signed on the said Stay-Order passed by District Judge and not only that but the certified copy of the said Order was obtained by the Opponent’s Advocate
On Next date in Criminal proceeding before JMFC , for unavoidable circumstances, I could not remain present as I was out of town but the Opponent’s Advocate appeared before the JMFC
And on that date the JMFC dismissed the Criminal proceedings
Opponents’ Advocate did not disclosed before the Magistrate that the matter was stayed by Session Court and hence the Criminal MA was disposed off.
Question
Whether it was not the duty of the Opponent’s Advocate to inform the JMFC that the matter was stayed by the District Judge
What actions can be taken againt the Advocate of the Opponent for concealing facts ?
