Aggrement

My aggrement of sale expires in this week, but not able to process due to flat is in mortgage with municipality. So in this case what happens to the advance given if contract expires.

Aggrement for sale consists of the following clauses

1)In pursuance of the aggrement of sale cosideration of xxxx and vendor has recived advance amount of xxxx as follows by the way of cheque from vendee and vendor do hereby admits and acknowledges the receipt the said sum and vendee will pay reamining balance xxxx with in xx from the date of aggrement.

2)That the rights, titles, interest will be transferred in favour of the vendee. And the vendors paid all taxes and dues in respect of the scedule property

3) where as the scedule property is free from all kinds of encumbrances, charges, sales, gifts, mortgages and other court attachments etc.

4)Where as the vendor further convenant with the vendee that if the vendee is deprived of whole or any part on account of any defect in the vendor title, the vendor shall indemnify and compensate the vendee against the same.

5)where as the vendor shall indemnify and keep the vendee's indemnified from all losses and expenses and other damages in respect of the sceduled peoperty here by conveyed

6)That the vendee shall hold and enjoy the sceduled property as an absolute owner as their likes without any let or hindrance either from the vendors or any other person or persons whom so ever.
