I am planning to buy flat in Pune from 2nd owner who has registered sale agreement and sale deed with 1st owner in 2010. 1st owner executed Apartment deed with builder in 2013 and there is reference of sale deed sr. no. mentioning that benefits of apartment deed will also get transferred to 2nd owner.
There is minor difference in Index 2 of sale deed and apartment deed. Apartment deed Index 2 mentions "proportionate undivided share (3,32%)" which is not present in Sale deed of 2nd owner.
Should I ask 2nd owner to correct this before going in deal or it's fine? What is procedure if 1st owner refuses/not reachable to make correction?
