Can anybody help?

Dear learned members

I am trying to find how to file a petition to Armed Forces Tribunal post retirement. Requested AFT online asking whether I am eligible or not. Got a googly asking me to refer AFT aCT 2007, aft Rules 2008 & AFT rULES 2009.

Dear Sir / Madam


My personal No is IC35816. I have retd from service in the rank of Lt Col(TS) ON 31 Jan 2009. During my service in the year 2000( posted then in NC) I submitted a complaint against a serving Brigadier for mis-using free railway warrant for his mother-in-law in the name of her mother who was dead. My complaint was addressed to CGDA New Delhi.By Jul 2000 I was ordered attached with a regimental centre(CC) by the order of AHQ. I was then told that a one man inquiry had been done which found me guilty of false accusation and hence my attachment order. Subsequently S of E was recorded. On completion of recording of S of E I was sent back to my parent unit after appx 2 years of attachment..A few months later I recd a show cause notice, replied but severely reprimanded recordable by the GOC-in-C Central Command.Govt of India upheld the decisions of the GOC-in-C.
 
Later in 2008 I made a statutory complaint to the govt of India under AA 27. Meanwhile I retired from service on 31 Jan 2009. In the year 2010 I was sent an order of the COAS( Gen Deepak Kapoor) disposing of my Statutory Complaint. It stated in its order that although the complaint lodged by the petitioner against the Brigadier in the year 2000 was found genuine but no action could be taken against the Brigadier as he had already retired in the year 2008 and the case has been time barred. It further ordered erasing the  sentence of Severely Reprimanded from my official records.The letter urged me to sign the original copy of the order and sent back to them urgently.
 
I wrote back to the originator of that communication that COAS had in-fact over stepped his jurisdiction as the my statutory complaint could only be disposed of by the govt of India.They have now sent me a reply quoting some provisions of AA26 and AR 364 which supposedly empower COAS to dispose of Statutory Complaints made ubder provision of AA27. 
 
I am now settled permanently at Secunderabad(AP). May I request your kind office to advice me whether I am entitled to file a petition to the AFT against the order of GOC-in-C ( CC) as well as COAS and to initiate displinary case against the Brigadier  who was let scot free in collusion.
