We had let out a premises to person in 2008, agreement was entered into and renewed for every 11 months, however from last 7 months he has not being paying rent, henceforth we filed an eviction suit after serving notice of terminating the agreement, asking him to clear the rent and vacate the premises (He didnt reply to the notice). Now my query is that in our agreement (which was in force until we terminated it) it is mentioned:
1. That the LESSEE can restore electric connection at his own cost and LESSEE shall pay electric bills on time and submit the same to LESSOR on a monthly basis
2. That LESSOR is empowered to get electric connection terminated at anytime wthout prior information/ obtaining approval from LESSEE.
Note: The Lessee has an elecric dues of 27000/- as of now and has not been paying the same for months neither has been submitting any bills to us. Connection is the name of LESSEE & this case is of Ranchi (Jharkhand)
Can we get his Electric Connection Disconnected, as he hasnt paid bills and lessor has the rights to get the same disconnected as mentioned in agreement??
