Case against company for Illegal Termination

 

This is with reference to my earlier blog on Labour case on Illegal Termination.

Pls find attached draft for claim statement to be submitted to court . I request your suggestions on corrections & improving the same .

Note : I have highlighted the reference of IDA section in bold . Pls suggest the relevant section .

Hi Prashat,

 

This is very informative.  Can you tell me till what period gap can an employee take up this matter.  In other words can a terminated employee take this matter with labour court even after 4-5 yrs.  pls revert. thanks...

I am fighting the case from past 2 years . Initialally went to Labour office & now at labour court . It is a long process & needs lot of patience my friend . Suggest to file civil suit which might take the process faster .

The opposite party has not placed any data on record, and may not.

It shall be appropriate to consult labor consultant/lawyer/law firm, who shall examine docs and suggest.

As per labor laws labor court is better option. It is unfortunate that system takes time to decide.

You have worked for a few months. Reinstatement with back wages shall be a heavy cost to the company.

They might have or they may approach you for settlement. Apply your wisdom, and take help.

It may take time but shall be rewarding.
