Change name of son

 Can anyone change the name of son when there is  divorse case is going between mother and father? Is father consent id required for change in name of son or make a passport for him

You cannot get the passport without consent of Husband. You have to obtain child custody and husband concern to do the same.

Minors names can only be changed by their parents/guardian as per the rule of the state of domicile

since u r saying that case of divorce is pending between th eparents of the child then it is difficult to change the name at this stage.

Yes it is required for change in name, and both of you need to sign the passport form....

I differ to all the opinions expressed above my reply.

1. In reference to context Passport Authorities only need you to give declaration (affidavit) in Form G and Format link is here

2. I also differ specifically to reply on State Rules by ld. brother as there has never been any such Guidelines / Order / Rule / Judgment / Authority. The only State Amendment recently this year was of Maharashtra Education Board where they done away with "need of father's name in school admission which was earlier compulsory" also another benchmark Regional Passport Office in Karnataka (Bangalore) as well as Maharashtra (Mumbai) done away with "need of Father's name in Passport of minors irrespective court case or no court case in present or past" hence only these two official Circulars are social NEWS for all concerned ld. borthers to take note of for their future clients purposes.
