Charges for PG

One of my client has a three 1 BHK flats combined together and made a 3BHK flat in co-operative housing society in Pune.

That family is of Husband wife and their 3 years old kid.

2 Bedrooms are lented out as PG's to girls.

The society is asking for non occupancy society charges on one flat as these are lented out to PG's.

As the owner himself is staying with the PG's there is no question as non occupancy in the flat.

Is it legal from society point of view to charge non occupancy charges for PG's in a single flat?

Please guide.
