Child custody without divorce

My son 5 yaers old, is not allowed to accessed by me (father) by his mother. We are leaving in the same house though. Can I file for child custody in this situation? How much time does it take to form date filling to get visitation rights? I have already approached childline.or.in. They did a primary investigation. And wating for their response. But don't know whether they will be able to provide me with my rights.

Yes, being the natural guardian you have every right to have the custody of your son. File guardianship case wherein also file interim application for interim relief.Consult a lawyer with details.
