Cooperative housing society bye-laws

I request the considered opinion of stalwarts in this forum whether a member of a cooperative housing society has the right to ask for  copies of quotations and bills of vendors who have been awarded a contract by the Managing Committee of the society.

Yes.  You can apply if you are a member of the society.

There is no provision in each of the states Cooperative Housing Acts, Cooperative Housing Rules and your Housing Societie's Bye laws that you can ask the cooperative housing society to show you such documents as well you can demand photocopies of the same against a nominal charges. But unfortunately management of almost 99% cooperative housing societies won't adhere to your request. On non furnishing of the same you can write to the PIO of the Cooperative Department but you won't get much cooperation from them too. But do write to them asking from them. The cooperative housing society as well as PIO is bound to furnish the above within a period of 30 days each. Don't forget to write to the PIO. Do affix a court fee stamp valued of Rs. 5.00 on your application to the PIO. Unfortunately there is a nexus between the cooperative housing department and cooperative housing societies in our country. All work for gains since being corrupt. I would suggest you not to fall in prey of any legal person since it is not required instead they too will make you fool. You can do it yourself. Please let me know in which states you are. Every member of a housing society has rights to seek for details of expenses including the bills obtained from the vendors on all the counts.

Acually the society has to funish all the details during the annual general body meeting  before the meeting.

The audited accounts can be discussed and the body has the right to question the irrelevant diocuments and expenses pertaining to unnecessary things as well and also can reject  the accounts stating that the same is fraud.

A contract for upgrading of the Fire Fighting System as per new norms specified by the government was awarded after approval of the proposal in the AGM.

1. One of the members of our Society obtained quotations of the vendors by bypassing the Managing Committee and instructing our Office Manager to send them to him by email. Does a member have a right to do this?

2. The project is nearing completion and a member has demanded to get a copy of the vendor's bill. Is the Society expected to give copies of bills of vendors to any member whenever he demands it, any time during the financial year?

The Office Manager is expected to place the matter before the Executive Committee and seek instructions. Moreover, projects of this nature could be executed only if the EC is ensured of sufficient autonomy.
