Court given final judgement under section 355 but what next?

Hi All,

Final judgement (given on last year) was announced after 6 years on cheque bounce case by XXIII Addl Chief Metropoliton Magistrate.

As per Court Order, it is mentioned as below:

"Acting under secion 255(2) of Cr.P.C the accussed is convicted for the offence punishable under section 138 of Negotiable Instrument Act, The accussed is sentenced to pay XYZ amount. In default shall under go simple imprisonment for 6 months, the bail bound and surety bond of the accused stands cancelled"

Even after this accused is not honoring court decision. BTW accused wife is Lawyer and influencing police.

Please suggest necessary course of action.

You have to get it executed either through Court or police. You have to file applicatoions before the Court by furnishing his correct address. Thereafter, court will beissued NBW against the accused. Further if you furnish the details of proeprties of accused then court will order for attachment of such properties and finally accused will be arrested and sent to jail.
