Cpc procedures

If a Court due to inadvertance failed to see that actually a suit is fit for rejection and so by mistake made such a suit analogous with another suit, then after 4 years when such mistake was discovered can the Court reject the defective suit and/or remove the analogous tab?

If the Court can then under which provision of law?

Dear Pritam Gupta,

The Hon'ble Court can dismiss the suit at any stage, if it founds the plaint filed by the litigant does not comply the Order VII of c.p.c
