Criminal cases, expired passport renewal and foreign travel

Dear Sir, Those who wanted to speak anything other than guiding me, please do not waste both of us time.

There is case on me U/S 272 a and f, for SMS abuse on my father in law and wife, and Dowry and other some default bullsh*t cases, that every evil wife tend to file for robbing all property. The cases are under trial, she did not come to court for last 5 years. All these cases are in Tamilnadu

Now, the question i ask is, my passport expired 3 yrs back, i plan to settle abroad, i want to get renew my passport, My original passport issued in Tamilnadu, different address,

Now I'm in other state, other address. 1 ) Do I need to get NOC from court to renew ?

2) NOC has its own complications, and consequences, what will happen if i do not mention about cases in passport renew application, will they able to map ?

3) If passport office finds cases information, i saw 5000 rs fine, will they mention anything in my passport for giving wrong information other than fine?

4) What should i say on visa application about cases, if i say no cases in passport application, then i have to say no cases in visa application too..is there any chance i get caught @ airport.

Please do not say i think against law, law is so generic, and it is misused by many women, that does not mean, one should suffer in all the way, i do not need lecture on ethics, morality etc..if you can answer legally please do answer, else leave it.

1. Expired passport of such lapsed time cannot be renewed first of all. You need to apply for fresh passport. Hope this is not time waste reply!

2. If no Court has given specific directions till date then no
NOC
required from Court to apply for a fresh passport. Hope this is not time waste reply!

3. Download Fresh Application Form for issuing of a fresh Passport. There are specific columns in it which ask from applicant about criminal cases pending or details thereof. Mention case no. / parties name and court details and no need to hide them nor in reference to context alleged pending cases Passport Authorities will refuse to service your fresh passport application without any direction of the concerned Court or MEA (State).

4. If you don’t mention then mentioned fine amount is penalty and may also result in suspension of very issued passport based on concerned jurisdiction RPO / PA's discretion.

5. You have to mention about pending court cases wherever asked and it is discretion of concerned Embassy / Consulate to issue a Visa or not based on their internal guidelines / policies but if a person has / had court cases s/he is required to mention true facts in specific places as and when asked.

There is no need to shout at member(s) of the Bar who reply to you. Law says speak the truth beyond that we also don’t need to hear your hyper lectures on generic law or gender biasness in reference to asked query (PERIOD)
