Decree obtained by fraud

If a Decree from the Trial Court is obtained by fraud, committed by the Defendant, can the Appellant in an appeal to the High Court inform the

High court of the fraud immediately in her appeal? What would be the procedure?

Any favourable judgment obtained from a court of law by misrepresentation or suppression of material facts amounts to playing fraud with the court, the judge added. The aggrieved person can challenge any such judgment or decree by way of filing an application seeking leave to appeal,
