Defamation

One  of  our  disgruntled  ex-employee   of  the Company  ,  is  continuouly  using  filthy   and  abusive  language  both  verbal  and written  .  What  legal  action is  available  to  stop  him  doing  so   before  filing  a  legal  defamtion  suit . He  was  employee  of the  same  departement  for  which  I  am  the  head  now.

You shall first issue a legal notice seeking some amount as damages and also an unconditional apology from the ex employee.  If he fails to do so, you shall file a criminal case of defamation or a civil suit for recovery of damages.

You may first send a notice of warning to him not to do such things in future and failing which you will lodge complaint with the police for creating Nuisance and seek his arrest.

Civil and Criminaql actions are common. But why not a suit for injunction not to utter or puyblish defamatory statements. Just think of it
