If a case filed under Civil Law, is getting postponed on every hearing date without any reson by the Judge, (because the judge is busy), is there any way to proceed to fix a date to hear the case ?.
Both advocates are available on the hearing dates. Are we at the mercy of the Judge ? Every postponment date is 3-4 months. Petition to advance the case is also not getting considered. The defendent is eager to request the case to be heard because this is a false case regarding a property dispute. Any suggestions by any body on the next course of action ?. The case is in a Sub-district court. Can the defendent give a petition in the High Court to give necessary directions ?
