Does case lie before labour commissioner

Respected Sirs,

A small query, an employee has worked at the post of Financial Controller for about 5 Years, he has been given his Full and Final Settlement but despite many exchange of mails and legal notice the company has not yet released his Encashment of EL for 84 Days.  and would this be covered under Delhi Shops and Establishment Act, 1954

 

Kindly guide me in this regard whether his case would lie before the Labour Commissioner or he has to file Suit for Recovery

Shops & Establishments Act,  was enacted to govern the service conditions of employees working in establishments covered by the Act.


Employers/Establishments covered by the Act, have to comply with Shops & Establishments Act, Shops & Establishments Rules and have to submit various registeres prescribed under the Shops & Establishments Rules.

Persons that are covered by the def. of 'Employee' as in the Shops & Establishments Act,  can seek relief as per provisions of the Act.

What does it describe on EL, leave encashment?
