Does Quash is applicable on 498A revision order by HC

Hi,

Can I approach High Court under section 482 of CrPC on the order passed by the same high court on revision case (back ground: discharge petition filed U/s 239 CrPC in 498A IPC case in Magistrate Court and then arroached to High Court U/s 397 CrPC).

Grounds:

High Court did not read all my points in the revision and did not made findings nad aslo not made findings on Citations from Apex Court.

Dear Siv,

It is advisable to refer to the concerned High Court's rules in this regard otherwise there are instances wherein various High Courts are allowing this.

no you cannot. you will have to approach the Hon'ble Supreme Court.

Yes. High Court can quash rape and murder.Its all in the whims of judges who never get impeached and Judicial Accountability ACt or Bill is meant to protect errant judges. But High Court Can quash 498A . Let the other party move the Supreme Court. The philipsophy of LAST COME FIRST SERVED apples in India.
