Domestic violence case

NOTE: This is a women's court case.

Hi All,

I really appreciate help from all of you. I am a widow and my husband passed away 3 years back. I was disowned by my in laws and currently I am living with my parents. I have 18 year old son and 15 year old daughter. We have filed domestic violence case as well as property civil case towards my brother in law.

This is about domestic violence case. As soon as we filed the domestic violence case, brother in law's lawyer argued that we have to file within one year of domestic violence happens. We counter argued that, not paying maintenance of me and my children is counted as domestic violence and it is being done right at the very moment. We had arguments in front of a judge  and We also gave written argument letter also.

In the mean time, my brother in law and his lawyer has stopped attending court session because of that my court case has been dragging on for 2 years. Now judge says that argument has never been done when we had arguments in last month. It feels like something is wrong with the judge or some monetary rewards were exchanged.

Question is:

1. What steps can be taken to make brother in law and his lawyer to be present at court hearing?

2. How to convince judge that arguments have been done because another argument would take 1-2 years more and I do not have enough money to even feed myself?

Please reply at the earliest, it is matter of life and death for me and my family.

The case should eventually come in your favor as they have completely stopped coming to court, next based on orders you can go for execution proceedings with immediate effect.  Wait for other experts to reply.  What you need is a honest lawyer who can deal with this on day to day basis and get you the orders.

Your lawyer should impress upon the judge to dispose off the case or ask for its transfer to some other judge.
