Empower 1 DIL and throw away 15 Senior Citizen Women is law

So it means you empower 1 Daughter in Law (wife) and throw away 15 Women (senior Citizens) this is what Domestic Violence Act, 2005 interprets to and people still say that women (wife) in India are not empowered lot and they are balas (sita and Draupadi) !

but i have one question how that woman i mean DIL can claim residential rights in property of MIL if husband is not staying there?

Good question.


1. She alleges that at one time it was her shared household (not mentione din the news reporting though) ! Also she has a good advocate it means.

The beauty here in the news reporting is that her husband is staying in a 'bachelor's pad' did you notice that from the news ? In my opinion DIL should be given equal rent or same pad as Son (her husband) or shelter home payment by husband simple fact is that residence rites is for covering destitution of a wife and not meant for 'equating" status but then in DV Act being loosely drafted each and every words and sections needs a writ filed by each and every husband in India then only this loose piece of women's Law will get defined properly.

In my opinion this case will go the same way - DV residence Hon'ble SC (Amitabh Dasgupta citation) way wherein DIL allegedly squatted at MIL property and was removed out and later on was asked to pay the rentals too from back date to MIL, I have already posted above re. some weeks ago in family law forum.

. Bottom line what emerges is;
a.  MIL / FIL property is never safe from any DIL.
b. As soon as a male child is born to Indian parents and he attains 21 years old kick him out of your household and let him marry or live saintly life it is his problem now atleast parents will have a shade over their head during their retirement days.


This is how family breaking laws are created and women still say they are asking compensation why can't they live in their father's property ?

i agree that in this case she shld have given accomodation in equality with husband or rental for shelter home.  have u came across any judgement where women was asked to stay in shelter home or to take rental needed to stay there?

if wife has not stayed even for a single day/night in in-laws home and has stayed with husband in separate rented home, whether still she can claim residence of in-laws to be matrimonial home? "(husband staying separately from parents even before marriage). 

u r right if we are going for equality of rights why not woman shld demand right of residence in father's home.

i have read that post of urs of supreme court judgement and thanks a lot for posting.
