Extra penalty charged than what is mentioned in the policy

This is Rahul, working in a MNC, where i had undertaken a degree sponsored by the company. I had left the degree 2 years ago for getting transfer, due to which i was charged a penalty of 76K INR. Where as in the policy, penalty is mentioned as 50K INR. When raised with HR, I was informed that the revised policy of 76K is not yet uploaded. I find this very illegal. A policy which is not yet uploaded, or communicated to all employees has been applied 2 years ago. Is it legal? Do i have the right to get back the recovered amount?Moreover is there any act/rules that a policy cannot be made effective unless its communicated to all employees or made available to all?

Instead of resorting to verbal communications, transact in writing and demand refund of overcharged amounts.

Record the statements of HR (audio/visual).
