Form Co-op. HSG soc. maha

Ours is buildeing with two wings and 32 flats in each wing. The building complited in year 1998. Out of total 64 flats about 35 are sold by the builder and balance is kept with him and not selling to anyone. As per maharastra co-operative society notification it is mentioned that the flat owners can form a co-op. hsg soc only if 60 % of the flats owners come together out of total constructed flats. Our percentage is below 60 % and builder is not selling the flats any more. Kindly advice how we can form a co-op hsg soc in this situation. Pl. note even without co-operation of builder method to form a society, we need 60 % flat owners out of total constructed flats.

What is required is minimum 60% registration of the flats.  Once you acheive this target,  at least 11 members of building pass a resolution for formation of society and appointing a person as chief promoter, who will submit the form for reservation of name with registrar.  Once the name reservation is given than you can proceed to follow procedure.
