Gift deed

Sir/Madam,

Recently a gift deed was executed (registered) by a father gifting his house to his son. Later on it was found that there were quite a few mistakes in the same including incorrect khata number. Can the deed be cancelled and made again. Both father and son are willing for the same.

The Gift Maker, may execute a "rectification deed" giving appropriate reference of the original Gift deed and annexing the same.  This will be a lot cheaper, then executing a fresh gift deed.

The natural heir is not required to get will from father, however Hemant rightly advised.

You have to make the Rectification deed for correcting the Mistakes in Gift Deed. If you reside in Delhi than the Rectification will be made on the Stamp PAper of Rs. 100/-, each state have different stamp duty for article.
