Supreme court on NBW. Many lower courts as a routine pass NBW orders even at the first instance which is illegal. It has been termed illegal by many HCs and even SC but now the SC has given specific procedure for issue of NBW.

The High courts have been direction to issue directions to all subordinate courts within six months but prior to that pl give a copy to your District court with request to implement the same. 

It will be great relief for NI 138 and specifically 498 a and other similar criminal cases.

PLEASE FIND ATTACHED THE JUDGEMENT COPY.

In case of transfer of cases...it is happening in many cases retrial.
