holding of adjourned AGM of a cooperative housing society

dear learned advocates

AGM of our housing society was held on 27th August, and it was adjourned by the MC without transacting all the agenda points.

now the MC has rescheduled the AGM on 27th September by deleting some points of the agenda and adding new points.

can the MC change the agenda of the AGM which was set up in the first AGM

your immediate answer would be highly appreciated

It is the responsibility of the committee of the housing society, to ensure that the AGM is held within the prescribed period. The notice for convening the AGM, has to be signed by the secretary of the society. The AGM of the society cannot be convened unless a notice of 14 days is given to the members. While computing the 14 days, the date on which the notice is issued and the date of the meeting shall be excluded. Once an AGM is called, it cannot be treated as invalid, unless an order declaring the meeting as such is passed by the cooperative court.

If you have any grievances over the changed agenda, you can record your objections to it in advance or on the date of the proposed AGM to be conducted.

It is the responsibility and duty of MC to submit agenda of AGM well in advance to all members.

For the adjoining AGM,

1. Again 14 days clear notice has to be given ?

2. Should it have Minutes if the previous 1st AGM which was adjourned
