how should i go about this problem

 

  • Boy is a US Citizen.
  • Got married in Chennai, India.
  • Got divorced in 2008 in Houston, Texas.
  • Girl needs to change name on passport to her maiden name but the Passport Office in Houston does not accept the divorce as a basis for name change. Girl must produce divorce documents from an Indian court.

1. Ask both of them to file for MCD in India as per jurisdiction with POA.
2. They need to also pray for overseas Video Conferencing with respective witness vouching them respectively here in India.
3. With 6 months cooling period wait both of them will get MCD Decree and certified copy of the same could be annexed backhome for maiden name change.

if it is not expartee decree, I think the passport office [Indian consulate] can accept...you can consult some attorney in USA, who can challenge the passport office's decision.
