How to cancel interim maintenance ?

Hi Lawyers,

My case has been running in Punjab court. During the cross examination my wife has already accepted that she is capable to work and presently working as a teacher in a school. Can you please tell me how can I cancel her interim maintenance? Between I have a daughter who is in the custody of my wife and she never allows me to meet her!!

As far as meeting your daughter is concerned , you could apply to the court throughout guardianship petition and seek an interim order for visitation rights urgently . The interim maintenance can be changed or modified owing to any change of circumstances which in your CAs would be your wife's added salary . So move a petition u/s 127 crpc seeking modification of interim maintenance .

File interim visitation petition praying for an order to bring her to court. If she doesn't obey, submit a memo stalling the proceedings until she does.
