How to get mobile tower details for 498a & dv case

Hi,

My wife filed 498a and DV case against me and she file in complaint that i went her place on such xy date and physically abuse her for dowry and she written name of her maid as witness in complaint.she lives in other state.

But that time i was not even in my home and not her home,i have following proofs with me.

1.Group photograph with whom i was present that time.i was in amusement park with 20 peoples.They are ready to give withness.

2.Photographs also showing the occassion but not showing any date of that day.

3.I have credit card transaction statement where i did purchases on that day.

Now my advocate asking me if any how i can get tower details of mobile company where i was present than it will become more strong case against them.

Is there any way if i can get tower detail to locate my position of that day.Is RTI applicable on vodafone/tata indicom/Airtel connections.I need details only for me not for others.

you have sufficient material. You can even ask court to summon CCTV footage of ATM.

You can file an application calling for the call details from the concerned network

with your id proof and address proof you can ask from your service provider if the number is postpaid.

telecom companies may not share old data - how old was the incident? What if they have deleted old data from systems, or if their data disk crashed? Cell phone location data is HUGEEEE and not sure how long they keep it. I once tried to get 1 year of my mobile bill, they said they keep only 6 months data.

For sake of arguing, i can say that you gave your phone to a friend who took it to amusement park.

###### Your friends, your atm/credit card transaction will be more useful I feel.

If you signed for your credit card then you are already safe ! Your signature and the location of your purchase will cover you 100%.

I am sure the day they have created this incidence would be a holiday itself ensuring your difciulty to proove your presence. Further, the FIR would be completed well planned have been loged in a computer printed form. ( check it out)

Even where ever you have used credit card they would also be having CCTV footage, just check it out if that is available with them. A Technical proof of your presence would sweep the case entirely in your favor. however your witness can also make the case stronger for you.

Mobile tower data is avaialable with service provider but thats not easily accessible to normal public, yes , on the court order it can be provided by the company. Usually crime branch access this data with ease.

you might have visted some doctor on that day get a proper medical certificate 9 registered practioner) of your examination on that day.

Take a note of cause of action date and FIR filing date, how much is the difference? wider difference bet ween them also create space for planned crime against you.
