I.O refuses to take the evidence

Hello everyone,

 

What is the solution when the Investigating Officer refuses to take the documentary evidence and later files a chargesheet implicating the accused?

These documents can be proved during examination in chief on behalf of reporter and may be used and proved, in cross examination on behalf of accused.

You can not compel to IO to take these evidence. You should try to change the IO. So meet the higher officers and tell the problem.  I hope it will be work.

If IO is from Police, resort to sec. 36 crpc and complain to Supdt. of Police.
