We have filed a Civil Suit in the Civil court which has been admitted. Can we file a petition before the consumer forum now? Will it amount to sub-judice?

G.L.N. Prasad (Retired employee.)     04 July 2017

Consumer forum is not a Court.  There is nothing so far that decided that states that filing in consumer forum amounts to subjudice, when a similar case is pending with Civil Court..

On the website - https://ncdrc.nic.in/

The National Consumer Disputes Redressal Commission (NCDRC), India is a quasi-judicial commission in India which was set up in 1988 under the Consumer Protection Act of 1986. Its head office is in New Delhi. The commission is headed by a sitting or retired judge of the Supreme Court of India. The commission is presently headed by Justice D K Jain, former judge of the Supreme Court of India. A quasi-judicial body is an entity such as an arbitrator or tribunal board, generally of a public administrative agency, which has powers and procedures resembling those of a court of law or judge.

It seems it functions like a court.
