IT is in continuation of my earlier post (Just half an hour earlier)
One thing I forget to point out that Hon,ble court had accepted an application of Defendant / defendant under Order 41 Rule 27 (submitting add.document that is notices ) just few minutes before the final hearing that is on 19.09.2012 and was not submitted before 24.04.2009 when once final hearing had already compleated appellant had deined in Written statement,Memorandum of appeal in High court having received these notices .under 41 (27) none of the conditions that is he was not having knowelege or could not produce them inspite of due delegence was fulfilled it was visible that hon,court was more intrested in submission of these documents than the appellant himself. These documents were years old arnd no case was filed on the basis of these notices.
